Public Interest Litigation (PIL) – Has it lost its relevance?
Getting underprivileged their rights to privileged misusing for their personal gains, the PIL remains a matter of discussion and a tool of Justice
PIL is a tool made available to the public by the court under judicial activism as PIL which provides a medium for legal representation to the marginalized, poor, and minorities citizens who are concerned about issues related to the public interest such as road safety, pollution, terrorism or a threat to communal harmony, etc. Through PIL, India’s constitution provides some of the most advanced social legislation systems, rarely traced anywhere in the developing world. In India, issues like bonded labor (debt slavery), exploitation of workers, and many others are the main burning issues addressed by the PILs.
There are always two sides to a coin. There will be people who will try and exploit (PILs), whether courts allow themselves to be misused… that is where the wisdom of the courts lies.
